The man accused of killing a 5-year-old Buffalo boy has also been charged with sexual abuse. Matthew Kuzdal, 26, faces a charge of second-degree murder in the September 15 beating death of Eain Brooks. Erie County District Attorney Frank Sedita says Tuesday Kuzdal is also being charged with predatory sexual assault against a child in his indictment by an Erie County grand jury.
Kuzdal shared an Albany Street apartment with the boy's mother, Nora Brooks. Family members say they contacted Child Protective Services numerous times with concerns over the boy's welfare.
Kuzdal is being held without bail at the Erie County Holding Center. He will be arraigned Wednesday in State Supreme Court.
Kuzdal faces a sentence of 35 years-to-life in prison if convicted of all counts.
