Buffalo man charged with killing 5-year-old boy

A Buffalo man has been arrested and charged with murder in the death of a 5-year-old boy.

Eain Brooks died from blunt force trauma to the head at Women and Children's Hospital Tuesday after he was beaten Sunday evening at his Albany Street home. Matthew Kuzdal, 26, his mother's boyfriend, has been charged with second-degree murder.

Police were called to the home and told the boy was injured after falling down the stairs. Police Commissioner Daniel Derenda upon arriving at the scene, authorities determined the story seemed fishy.

"When you have a 5-year-old that's injured and in critical condition, we would investigate. But almost immediately, things, with the extent of the injuries, did not add up," Derenda said at a Thursday afternoon news conference at police headquarters.

Derenda say Kuzdal has made some statements implicating what he did to the child, but would not elaborate.. Kuzdal was the only person home with the boy at the time. The accused has numerous arrests on his record for various crimes.

Mayor Byron Brown calls it a "very distributing" and "terrible crime."
