A surveillance video shows a man who was fatally wounded by a Buffalo police officer early Wednesday appeared to be running away moments before he was shot.
The video was shown by attorney Steven Cohen Saturday to WBFO's partners at Investigative Post and two other media outlets. The family of shooting victim Rafael "Pito" Rivera has retained Cohen.
Buffalo police investigators and the Erie County District Attorney's office are in possession of the video. Police say Rivera was holding a gun and failed to obey orders to stop.
Cohen questions why police fired at Rivera while he was running away.
