A nine-year-old whistleblower civil lawsuit against Amherst-based Independent Health now includes the U.S. Justice Department.
The suit is against Independent Health, an affiliate company DxID, which closed in June, and that subsidiary's former CEO, Betsy Gaffney.
The Justice Department alleges that Independent Health submitted inaccurate Medicare data that resulted in millions of dollars worth of over-reimbursements by the government. This was in violation of the False Claims Act regarding Medicare Advantage Plan beneficiaries.
“Defrauding taxpayer funded health care programs such as Medicare hurts not only taxpayers but our nation’s entire healthcare system,” said U.S. Attorney James Kennedy in a statement.
Independent Health denies the accusations, saying it properly documents its patients' medical records.
