The owner of a North Buffalo strip mall wants to split the property into three pieces, perhaps to sell off the properties individually.
The land includes the Regal Elmwood Center movie theater. The New York City real estate investment trust that owns the property was before the city Planning Board Monday because splitting the property requires City Hall approval. It also shows business is continuing, even in these times.
"One is what we call the Regal Cinema parcel and that would be approximately 9.3 acres," said lawyer Francis Gorman. "The second parcel is the Gordon Food parcel and that parcel would be approximately 3.6 acres. And the third parcel is what we refer to as the Checkers parcel and that is approximately .25 acres."
The Planning Board approved creation of the minor subdivision, but the Department of Permits and Inspection Services has final approval. The plan requires vehicle access to the Checkers restaurant so fire trucks can get to what would otherwise be a land-locked land parcel. That requires easement agreements for the sites in case they are sold, which are being prepared.
"There is a reciprocal easement agreement that there's a couple that currently are in place," said Gorman, "and then we are filing an additional reciprocal easement agreement that will give Checkers access to Elmwood Avenue and the same for the Gordon parcel."
In other activity, one property owner wanted a city permit to continue short-term rentals with a North Buffalo two-family flat. Another applicant wanted to start a garage on Military Road and another person wanted an outdoor restaurant on Rhode Island.
