The West Virginia University Board of Governors has settled a lawsuit over the 2014 death of a student from Williamsville.
Nolan Burch, 18, was found unconscious and not breathing at the Kappa Sigma fraternity house in Morgantown. Police determined it was an alcohol-related death.
The state Board of Risk and Insurance management agreed to the settlement in which the University board denied liability in the death, but settled with the family for $250,000. As part of the settlement, the insurer also paid a $20,000 donation to WVU Children's Hospital Critical Care Services and $5,000 to the Center for Organ Recovery and Education.
Gov. Andrew Cuomo signed a new anti-hazing law in August, inspired by Burch's death. The law prohibits certain physical contact or requiring physical activity during an organization's initiating ceremony to prevent the deaths or serious injuries of students during fraternity pledging.
