Buffalo, NY – Former Buffalo Common Council member Brian Davis was indicted Wednesday by a federal grand jury.
U.S. Attorney William J. Hochul, Jr. announced late Tuesday afternoon that Davis, 41, was indicted on four counts of theft concerning programs receiving federal funds. The charges carry a maximum sentence of 10 years in prison, a fine of $250,000 or both.
Davis is charged with stealing money designated for the impoverished Ellicott District that he once represented.
The indictment says Davis diverted at least $5,000 per year to himself and associates during his four year Council term from federal grants distributed through non-profit and community organizations.
Davis resigned from his Council seat two years ago after an investigation found he had diverted campaign contributions into his personal bank accounts.
"This Indictment should serve as a reminder that public officials are in a position of trust and that taxpayers funds are not intended for personal gain but for the public good," said U.S. Attorney Hochul.
Wednesday afternoon Hochul met with reporters to discuss the indictment.
"Mr. Davis is alleged to have obtained his money through the use of pass through agencies. And there are three different agencies mentioned, Community Action Organization,Back to Basics and Pratt Willard. None of these three public agencies or community agencies are accused of any wrongdoing," said Hochul.
If convicted, the charges carry a maximum sentence of ten years in prison.
Last week Davis was arrested on drug possession charges.
Davis will be arraigned Monday, May 16th at 4 p.m. in U.S. District Court, Buffalo, NY.
