In September, landlord Douglas Ritter tried to evict the Garcia family in court, but the courts were backlogged. By the time the case came in front of a judge in January, the family had applied for the state’s Emergency Rental Assistance Program. Because of that, their case was stayed indefinitely. The family says Ritter is now using illegal means to make them leave.

New York’s eviction moratorium expired over the weekend, but tenants who applied for rent relief through the state’s Emergency Rental Assistance Program cannot be legally evicted, even if their application is still being processed.

Gov. Kathy Hochul told reporters Friday that she has not yet determined whether the state will extend the soon-to-expire eviction moratorium. Some housing advocates are disappointed the governor failed to address the moratorium in her State of the State agenda.
