Dollar General stores sued over ADA inaccessibility

Disability Rights New York has filed a class action lawsuit against the Dollar General Corporation for failing to make their New York stores accessible to people with mobility disabilities. The lawsuit was prompted by Jennifer Rossman, a wheelchair user in Oneonta, NY. Rossman claims she is unable to shop at Dollar General because of large stocking carts, cardboard displays and merchandise stacked in aisles and outside the store’s entrance.

DRNY says it found similar accessibility problems in 75 other New York Dollar General stores and claims the stores violate the Americans With Disabilities Act and New York State law, which prohibit discrimination based upon a person's disability in places of public accommodation.

Without a class action, DRNY says the stores are likely to continue their policy and practice of operating inaccessible stores. The suit says there are more than 14,500 Dollar General stores in 44 states across
the United States, including 325 in New York State.
