West Virginia University's governing board has responded to a wrongful death lawsuit brought by the family of Williamsville native Nolan Burch.

WVU's Board of Governors argues that it did not sanction any events that led to Burch's death in November 2014.

Burch died two two days after binge drinking while pledging for Kappa Sigma fraternity. Alcohol poisoning was found to be the cause.

The family's lawsuit alleges negligence on the part of WVU, the Kappa Sigma national chapter, and other entities.

Avery began his broadcasting career as a disc jockey for WRUB, the University at Buffalo’s student-run radio station.
