A State Supreme Court decision will remove the ban on outdoor smoking in some venues. The ban was put in place to protect bystanders from secondhand smoke. Justice George Ceresia ruled that there is no Legislative policy to support a smoking ban at numerous state parks and beaches.
City bans on outdoor smoking were not contested in the lawsuit.
Indoor smoking bans were also not addressed in this action.
