Kennedy calls for state investigation into Erie County CPS

A state lawmaker is calling for a full investigation into the events leading up to beating death of a 5-year-old Buffalo boy.

Eain Brooks died Tuesday from blunt force trauma to the head after he was beaten in his Albany Street home on Sunday. Matthew Kuzdal, the mother's boyfriend, has been charged with second-degree murder. 

Senator Tim Kennedy of Buffalo is demanding the state Office of Children and Family Services conduct a full-scale investigation. Kennedy says he is outraged after learning the grandmother and biological father made a number of calls to Erie County Child Protective Services prior to the boy's death.

"Erie County Child Protective Services failed Eain Brooks," Kennedy said Friday. "It should never, ever have happened and it should never happen again."

The boy's grandmother says she contacted Child Protective Services up to ten times, pleading to remove Kuzdzal from the home. His biological father also he says he made numerous calls to CPS.

"The most horrific situation that anyone could possible imagine has been perpetrated upon a little boy who is now dead because an agency that is mandated to protect that little boy and others like him didn't do his job," Kennedy said.

The Erie County Executive's office says is not allow to discuss the case as it is being investigated by both the county agency and police.
