DWI arrest reduced to violation for son of Niagara County sheriff

The son of Niagara County Sheriff Michael Filicetti was acquitted Tuesday in Wheatfield Town Court of a charge of driving while intoxicated.

The verdict came nearly a month after a non-jury trial.

Alex Filicetti, 24, was arrested just after midnight Feb. 28, after his pickup truck sideswiped another vehicle in a driveway on Moyer Road, near the Upper Mountain Fire Company. Lewiston police said a test showed his blood alcohol level at 0.14%, nearly double the legal limit of 0.08%.

The younger Filicetti was found guilty of unsafe backing — a traffic violation — and was fined $125 plus a $93 surcharge.

The case was transferred from Lewiston to Wheatfield and the Erie County District Attorney's office prosecuted the case after the Niagara County DA's office recused itself.
