Wanakah Grill owner sentenced for tax evasion

Wanakah Grill

A Lake View restaurant owner has been sentenced in Erie County Court for failing to pay New York state sales taxes.

James Rath, 60, owns the Wanakah Grill in the town of Hamburg. The Erie County District Attorney's Office says he admitted to failing to pay $40,661.63 in state sales taxes from March 1, 2014-Feb. 28, 2018.

Rath pleaded guilty to a misdemeanor charge of fourth degree attempted grand larceny on Sept. 19 of last year. The crime is a Class A misdemeanor.

He has since paid full restitution to the state. Rath was sentenced to to a one year conditional discharge.
