The Wyoming County Sheriff has released more details about the investigation into the suspected murder of a Perry man by Councilman Joseph Mlyniec, 60. Mlyniec is charged with murder in the second degree in the fatal shooting of Robert Irvine III, 32.
Wyoming County Sheriff Gregory Rudolph said forensic investigators have searched the Mlyniec home and property, assisted by New York State Department of Environmental Conservation K-9 officers, State Parks Police and State Police.
Rudolph said on Friday, Monroe County Coroner Renee Hill conducted an autopsy, which ruled Irvine's death a homicide. He said the autopsy found Irvine was shot four times with a 45-caliber handgun, however it will be several months before toxicology results are available and many more interviews will be conducted to establish a timeline for the shooting.
Wyoming County District Attorney Donald O'Geen said Mlyniec has waived his right to a felony hearing and the suspect will not appear in Warsaw Town Court Monday as earlier reported. A new date of May 21 has been set, and the case is expected to be presented to a grand jury and transferred to Wyoming County Court in the interim.
There had been earlier concern about a conflict of interest by the Wyoming Town Court, given Mlyniec is a retired Sheriff sergeant, but authorities said he has been cooperating. Mlyniec remains remanded to the Wyoming County jail without bail.
It was March 7 just before 6 p.m. when the Sheriff's Office received a 911 call from Mlyniec's home on Route 246 in Perry. The Sheriff said it was Mlyniec reporting the shooting.
