Time is running out for Occupy Buffalo to stay in Niagara square.
Buffalo Mayor Byron Brown was asked about the future of Occupy Buffalo as the group's permit with the city is set to expire Wednesday.
"They have been a very professional group. They have worked well with the city. There have been very few problems and we have respected their Freedom of Speech rights," said Mayor Brown.
Mayor Brown said discussions are being held on whether to extend the Occupy permit. Holding the city back from making a decision, the Buffalo Winterfest & Powderkeg Festival scheduled to take place in Niagara Square in a few weeks.
Brown said it is up to the event organizer if they want the occupy group to vacate Niagara square.
"If the event permit holder wants to have the entire space then the agreement that we have will require the group to voluntarily move," said Mayor Brown.
Festival organizer Drew Cerza tells WBFO News this years event moved from Seneca street to Niagara square for more room.
"It is a winter fest and they do have some grassy area around Niagara square, so we're really going to need all that space, I believe. We're going to wait until Wednesday and see what the city does and then we'll have some conversations with the occupy people and see where we take it," said Cerza.
The Occupy group signed previous documentation stating that if another group would like to use Niagara square they would leave peacefully.
Occupy Buffalo member Vicky Ross said the group is hoping to work something out with the festival to stay in Niagara square.
"We would certainly be happy to participate, cooperate, enjoy the festival, help them out in whatever way they like and certainly stay out of their way or whatever is going to make that work together," said Ross.
Ross said she is staying positive that an agreement will work for everyone. She said there are no plans yet on what will happen if festival organizers want the group to leave the square.
