The Buffalo Common Council overwhelmingly approved new rules for food truck operators.

If signed into law by Mayor Byron Brown, food trucks would not be allowed to park within 100 feet of an existing restaurant or a hot dog vendor.

They would also be prohibited from operating within 500 feet of a sanctioned city food festival.

Common Council president Richard Fontana said he still believes some of the brick and mortar restaurant owners would like to see the rules tweaked even more.

"They would like to see one truck per block instead of multiple food trucks parking next to each other and blocking other businesses.  They felt that one per block would be better.  I tend to agree with them," said Fontana.

There will be a fee for food truck operators . They would be required to pay $1,000 a year.

There is a provision in the law the permits local establishments to waive the distance restriction.

Some bars in the city, see the presence of food trucks as a way of helping rather than hindering their business.

The downtown business district will continue to operate under a different set of rules.

Mayor Brown had previously stated he would sign the new regulation once agreed to by all sides in the matter and the Common Council.

Fontana tells WBFO News says he believes the mayor will stick to his promise and sign the new legislation.

"Yes he has, I don't he expect any change in that position," said Fontana
