Judge issues gag order in McCray

By Eileen Buckley & Ashley Hassett

Buffalo, NY – The judge has issued a gag in the Riccardo McCray case. Erie County Court Judge Sheila DiTullio issued the gag order before the started of jury selection Tuesday morning.

McCray is accused of killing four people and wounding four others outside the City Grill on Main Street last August.

The prosecution and defense will not be allowed to talk with the media. WBFO News producer Ashley Hassett was in the courtroom Tuesday morning when the judge made the ruling. Judge DiTullio stated that she would "not allow this case to be tried in the media". The judge cited a comment made Tuesday by defense attorney Joseph Terranova to reporters. It was in reference to four inmates from the holding center who are going to be informants and testify against McCray. Terranova state "the human cockroaches come out of the shadows in all of these high-profile cases. And they're willing to say what it takes to benefit themselves." (You can click the above audio to hear Terranova's comment)

Media will be allowed to cover the case, but will be limited in recording courtroom proceedings. No texting or blogging will be allowed. A pool video photographer and a Buffalo News photographer will be allowed to cover the opening and closing statements.

Jury selection is underway.
