Questions raised by Thompson's proposed legislation

By Chris Jamele

Buffalo, NY – State Senator Antoine Thompson has introduced legislation that would expand the definition of a serious injury in a personal injury lawsuit. The law is being supported by members of the New York Trial Lawyers Association and members of the State Assembly.

Questions have arisen, though, regarding the timing of the bill.

The Buffalo News reports that Thompson introduced the legislation after filing a lawsuit against a trucking company and its driver in connection with an accident wherein Thompson suffered a shoulder injury. Thompson's legislation would cover his injury and be retroactive to cover the time period of his accident.

The Senator calls these details coincidental, though he has removed his name from the bill's sponsorship.
