Tests show home intruder was drinking

Buffalo, NY – Toxicology tests on the Albany teacher shot and killed after mistakenly entering the wrong home in Amherst reveal that he was legally intoxicated.

The Buffalo News is reporting that David Park's blood-alcohol level was .18 -- that level is more than twice the legal limit for driving in New York State.

Park was killed on March 28 after entering a home through an unlocked door on Millbrook Court in Amherst. The homeowner told authorities that he repeatedly warned Park to leave before firing.

Evidence in the case will be presented to a Grand Jury within the next two weeks.
