Contractor Fined for Webb Building Violations

Buffalo, NY – A Hamburg contractor has been fined for alleged safety violations at a building in downtown Buffalo where a worker fell to his death two months ago.

The US Occupational Safety and Health Administration says David Burke Construction of Hamburg has been fined $49,000 for failing to provide the required fall protection measures during renovation of the Webb Building.

Jonathan Fundalinski, 24, died on March 20th when he fell 30 feet while working on the second floor of the 19th-century building.

OSHA says Fundalinski fell through some missing floor sections and landed in the basement. Inspectors say no guardrails or safety nets were being used and workers didn't have safety harnesses.

Burke Construction has 15 business days to request a conference with OSHA officials to contest the fines.
