Buffalo, NY – Federal Magistrate Kenneth Schroeder has postponed Friday's detention hearing for Lackawanna Six suspect Sahim Alwan.
Judge Schroeder ruled last week that Alwan had a right to confront Faysal Galab about statements Galab made about Alwan in a plea agreement last month.
Galab claimed Alwan told him to lie about their trip to an al Qaida training camp. Galab also said Alwan personally met with Osama bin Laden. Those statements are the basis for a government motion seeking to revoke Alwan's bail.
In arguing against having Galab take the stand, prosecutors say defendants only have a right to confront witnesses when the accuracy of their statements is in question. Since Alwan did not dispute Galab's assertions, argues the prosecution, Galab should not be called.
There's no word on when Alwan's hearing will be rescheduled. Even though Alwan was granted bail last October, he so far has been unable to post it and remains jailed.
